Employees may face unfair treatment in the workplace at any point in their careers. Watching lesser experienced and skilled employees get promoted while you stay in the same position for years, getting the weekend shift while the other employees enjoy their weekends off, getting fired because the boss had to let someone go, and you were your boss’s least favorite employee are all examples of unfair treatment.
Anyone may fall victim to such unfair treatment at the workplace, and it can have severe effects on your mental health. It can be demoralizing and humiliating. Do you know that if you face unfair treatment, you can file a legal claim against your employer?
Employment by will
Employees are considered to be employed by will. This gives the employer the right to fire them from the job for any reason. Exceptions to this generalized and common rule are where the termination of an employee’s job violates the employee’s contract rules and regulations. This means that if your employer violated your employment contract or breached a law, you have the right to file a legal claim against him.
How is an employment contract breached?
Most of the employments are of the “by will employment” type; however, there may be situations where the employer and the employee have specific rules regarding their relationship, including the conditions in which the employee can be fired. Such cases can be seen with employees at the executive level. The rules may also extend to the types of benefits the employee will get, the salary, leave allowance, and much more.
In such cases, if the employer does not follow these terms, you can file a legal claim against him for breaching your contract. For example, if they pay you less than what was decided in the contract, or if the employer fires you for the reason that was not mentioned in the agreement, you can file a legal claim against your employer. Employment lawyers in Kansas City can help you get your rights and free you from unfair treatment at your workplace.
Discrimination
Breaches in the employment contract are not the only ground for filing a claim against your employer. You can sue your employer if you experience discrimination at work. It is illegal for employers to discriminate against their employees on certain set characteristics.
According to the law, it is illegal to discriminate your employee based on their race, color, gender, age, disability, religion, national origin, marital status, sexual orientation, arrest record, political activities, military status, a victim of domestic violence, or unemployment status, and pregnancy. This law differs from country to country and may include an even wider range of characteristics against which it is illegal to discriminate against your employees.
Are you experiencing unfair treatment at work?
You can not consider all unfair treatment at work to be a ground for filing a lawsuit against your employer. Legal claims can be filed against unfair treatment that violates a law or employment contract terms. If you are experiencing unfair treatment at work, then you should at once contact an employment attorney who will help you understand your claim and help you get the rights you deserve.
